A U.S. business enterprise includes any organization, association, branch, or venture which exists for profit making purposes or to otherwise secure economic advantage, and any ownership of any real estate which is held for profit making purposes*. If this applies to you, you may be required to complete the BE-12 benchmark survey by the end of this month.
The Bureau of Economic Analysis (BEA) recently started to conduct the BE-12 Benchmark Survey of Foreign Direct Investment in the United States. The BE-12 survey is conducted every five years and covers the fiscal year ended in 2017. It is required to be filed in two situations:
Situation #1: If you receive a letter from the BEA notifying you that a BE-12 report is required to be filed.
Situation #2: A BE-12 report is required for each U.S. incorporated or unincorporated business enterprise in which a foreign person or entity owned or controlled – directly or indirectly – 10 percent or more of the voting securities or an equivalent interest, at the end of the business enterprise’s fiscal year that ended in calendar year 2017.
The BE-12 Survey is due May 31, 2018 if it is filed on paper. If it is submitted using eFile, it is due June 30, 2018. Click here for more information or to complete the survey form.
